CONCERNING
THE APPOINTMENT OF SURVEYORS AS EXECUTORS OF VERIFICATION OR
TECHNICAL SURVEILLANCE OF THE IMPORT OF NON-NEW MACHINES AND MACHINERY

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

a. that in the framework of implementing the provisions in Article 7 point 1 and Article 10 of Decree of the Minister of Industry and Trade No. 756/MPP/Kep/11/2002 on the import of non-new machines and machinery as already amended by Decree No. 411/MPP/Kep/6/2003, it is necessary to appoint surveyors as the executors of verification or technical surveillance of the import of non-new machines and machinery;
b. that in relation thereto, a decree of the Minister of Industry and Trade needs to be issued;

In view of:

Decree of the Minister of Industry and Trade No. 756/MPP/Kep/11/2002 on the import of non-new machines and machinery as already amended by Decree No. 411/MPP/Kep/6/2003;

DECIDES:

To stipulate:

FIRST:

To appoint:

1. PT Surveyor Indonesia; and
2. PT Superintending Company of Indonesia (PT Persero SUCOFINDO)

As the surveyors executing the verification or technical surveillance of imported non-new machines and machinery.

SECOND:

The surveyors as meant in FIRST Dictum are as signed:

1. to verify or undertake technical surveillance of the import of non-new machines and machinery;
2. to issue certificate of Inspection certifying:
a. that the imported non-new machines and machinery remain feasible to use and recondition for re-functioning, not scrap and give information on their technical specifications; or
b. the truth (conformance) of specification, mark, model or type, manufacturing year or age, chassis and engine number, engine power, cylinder capacity, grow vehicle weight (GVW) and axle configuration of imported non-new motor-vehicle.

THIRD:

The verification or technical surveillance as meant in SECOND Dictum point 1 is applied to non-new machines and machinery subsumed into Tariff Headings HS 82, 84, 85, 87, 88, 89 and 9009, except those prohibited from being imported as contained in Attachment I to Decree of the Minister of Industry and Trade No. 756/MPP/Kep/11/2002 on the import of non-new machines and machinery.

FOURTH:

The imported non-new motor-vehicle as meant in SECOND Dictum point 2 letter b consist of:

1. non-new goods-transport vehicle subsumed into Tariff Heading HS 8704.10.100, 8704.23.190, 8704.32.190 and 8704.90.190; and
2. non-new vehicle constructed mainly to pull and push other vehicle subsumed into Tariff Heading 8701.20.000.

FIFTH:

In executing the verification or technical surveillance of the import of non-new machines and machinery, the sur-veyors can collect compensation for the rendered service from importers of non-new machines and machinery with the amount adjusted to the principle of benefit.

SIXTH:

All costs spending for the implementation of this decree become responsibility of the surveyors.

SEVENTH:

Technical provisions related to the implementation of this decree are stipulated by the Director General of Foreign Trade, Ministry of Industry and Trade.

EIGHTH:

This decree comes into force as from the date of stipulation.
